This Indenture

made the 24th day of March One Thousand Eight Hundred and Seventy One Between John George Harrison of Park Leys in the parish of Alderminster in the county of Worcester gentleman of one part and John Middleton of Leamington Priors in the county of Warwick builder of the other part. Whereas by indenture having date 24th day of March One Thousand Eight Hundred and Sixty Eight and made bteween William Thomas Freeman of the first part, of the first part, Priscilla Freeman of the second part and the said John George Harrisonof the third part the piece of land hereinafter particularly described and intended to be hereby conveyed now together with hereditaments conveyed unto and to the use of the said John George Harrison his heirs and assigns for ever

 

And Whereas the said John Middleton hath contracted with the said John George Harrison for the purchase of the fee simple of and hereditaments hereinafter described and intended to be

conveyed free from all encumbrances for the sum of Forty Five Pounds Five Shillings. Now this Indenture Witnesseth that in pursuance of the said contract and in consideration of the sum of

Forty Five Pounds Five Shillings sterling to the said John George Harrison now paid by the said John Middleton the receipt whereof the said John George Harrison doth hereby acknowledge

and therefrom doth acquit release and discharge the said John Middleton his heirs executors and administrators and every of them for ever by these presents. He the said John George Harrison

doth grant and convey unto the said John Middleton and heirs

All that piece or parcel of land situate in the parish of Leamington Priors in the said county of Warwick containing two hundred and eight square yards or thereabouts being part of a larger piece of land called Waltons Strawberry Gardens containing threeacres three roods and thirty six perches or thereabouts conveyed to the said John George Harrison in and by the herein before reciting indentures and particularly described in the mapor plan enclosed on the second skin of such indenture and thereon coloured pink bounded on the North on which side it measures eighteen feet three inches or thereabouts by anew road of the width of thirty feet and called Saint Georges Road on the south on which it measures eighteen feet or thereabouts by the back of Scotland Place on theon the East on which side it measures one hundred and four feet or thereabouts by land belonging to the said John George Harrison and John Smith and on the West on which side it measures one hundred and three feet six inches or thereabouts by other property of the said John Middleton which said piece or parcel of land intended to be hereby granted and conveyed is delineated on the plan drawn in the margin hereof and hereon coloured pink together with a right for the said John Middleton his heirs and assigns and others and occupiers for the time being of the said piece of land intended to be hereby granted and conveyed to use the said thirty feet road intended to be called Saint Georges Road forming the Northern boundary showed as aforesaid for all the ordinary purposes of a foot horse carriage or cart road in common with the said John George Harrison his heirs and grantees together also with all fences fixtures walls ways waters watercourses rights members easements and appurtenances whatsoever to the said hereditaments and premises respectively belonging or in any wise appertaining and the reversion and reversions remainder and remainders rents issues and profits thereof And all the estate right title use trust property claim and demand whatsoever of the said John George Harrison or thereto  To have and To hold the said piece of land hereditaments and premises with the  appurtenances unto and to the use of the said JohnMiddleton his heirs and assigns for ever And the said John Middleton doth hereby declare that no woman who shall become his widow shall be entitled to dower out of the said hereditaments and premises And the said George Harrsion doth hereby for himself his heirs executors and administrator covenant with the said John Middleton his heirs and assignsthat not withstanding any act or deed by the said John George Harrison done permitted or suffered to the contrary the said John George Harrison now hath in himself good right and absolute

authority to grant and convey the said hereditaments and premises with the appurtenances ro the use and in manner aforesaid And Further that it shall be lawful for the said John Middleton his heirs and assigns at all times hereafter peaceable and quietly to enter into and to hold and enjoy the said hereditaments and premises with the appurtenances and to receive the rents and profits thereof without any interruptions whatsoever and that free from all encumbrances whatsoever And Moreover that he the said John George Harrison and his heirs and any other person having or claiming any stake or interest in to or out of the said hereditaments and premises from under or in trust for him or them shall and will at all times hereafter upon every reasonable request and at the proper costs and charges in the law of the said John Middleton his heirs and assigns make do and execute or cause to be made done and executed all such further acts deeds matters and things whatsoever for more effectually granting and conveying the said hereditaments and premises with their  appurtenances unto and to the use of the said John Middleton his heirs and assigns or otherwise as shall be reasonably required by or on behalf of the said John Middleton his heirs and assigns and at the proper costs and charges of the person or persons requiring the same produce or cause to be produced to him or them or to his or their nominee or nominees or in any judicial investigation or otherwise  in England as occasion shall require the several Deeds Evidence and Writings mentioned in the schedule here under written or any or either of them for the manifestation and defence of the Title of the said John Middleton his heirs and assigns and shall and will at all times upon the like request and costs as aforesaid furnish copies abstracts or extracts of or from the same Deeds Evidence and Writings or either of them attested or unattested and shall and will at all times hereafter keep the said Deeds Evidence and Writings safe whole uncancelled and undefaced unless prevented from doing so by fire other inevitable accident And the said John Middleton doth hereby for himself his heirs executors administrators covenant with the said John George Harrison his heirs and assigns that he the said John Middleton his heirs and assigns shall not erect any house fronting to Saint Georges Road aforesaid of less frontage than fifteen feet to the said road
